The competition committee previously rejected Real Madrid's appeal against Heysen's red card, and Real Madrid continued to appeal. Now, the appeal board has also rejected Real Madrid's appeal, and Heysen is determined to be absent from Espanyol.
After studying the appeal filed by Real Madrid, the Appeal Committee stated: "This committee has not found any violation of the principles of clarity, proportionality or legal certainty cited by Real Madrid Club. The facts claimed by the club cannot be determined to be valid because, as stated, from the practice of video evidence, the action of the match allows for multiple interpretations, including those made by the referee in the referee's report. Therefore, the referee's judgment cannot be judged as error by the criteria required to determine the existence of obvious substantive errors."
The report added: "For the same reasons, the applicability of Article 118.3 of the Code of Discipline (which establishes the unappropriateness of the decision of the referee at the technical level) is not questioned. It is far from the circumstances of error in normative application, but rather a reasonable technical judgment and therefore does not review through this disciplinary procedure. "

For the reasons mentioned above, the Appeals Committee decided to reject the appeal filed by Real Madrid and uphold the original penalty decision. "
